Welcome to B's House of Cakes Houston. These Terms of Service ("Terms") apply to your use of https://www.bshouseofcakeshouston.com/ (the "Site") and your purchases from B's House of Cakes, doing business as B's House of Cakes Houston ("we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site or place an order.

2.1 Cottage Food Disclosure (Please Read Before Ordering)

We operate as a cottage food production operation under the Texas Cottage Food Law. Before you pay, please note:

This food was made in a home kitchen and is not inspected by the Texas Department of State Health Services or a local health department.

Ingredients and allergens: Ingredient lists and major allergen information are provided on each product label and, for oversized items such as custom cakes, on your invoice or receipt. Our kitchen uses wheat, milk, eggs, tree nuts, peanuts, soy, and other common allergens, and cross-contact can happen.
Safe handling: To prevent illness from bacteria, keep this food refrigerated or frozen until the food is prepared for consumption.

If you or a guest has a food allergy, please contact us before ordering at 832-303-7106 or bshouseofcakes@gmail.com. We cannot guarantee any item is free of any allergen.

2.2 Our Sweet Promise & Refund Policy

Every treat we make is baked fresh to order, with care, in small batches. Because our baked goods are perishable and can't be resold or returned, all sales are final, and we do not offer refunds or exchanges.

That said, we want you to be delighted. If something isn't right with your order, such as a mistake on our end, damage during pickup or delivery, or an item that doesn't match what you ordered, please contact us within 24 hours of pickup or delivery at 832-303-7106 or bshouseofcakes@gmail.com, with your order number and a photo if you can. We'll gladly make it right with a remake or store credit, at our discretion.

This policy does not limit any rights you have under applicable Texas or federal law.

2.3 Orders, Changes, and Cancellations

Placing an order: An order is confirmed only after we accept it and you receive a confirmation from us or from Square. We may decline or cancel an order if we can't fulfill it, and we'll refund you in full if we do.
Changes and cancellations: You may change or cancel an order up to 7 days before your pickup or delivery date. After that, ingredients have been purchased and baking has begun, and the order cannot be canceled or changed. Deposits are non-refundable.
Custom orders: Custom designs are made for you specifically. We do our best to match your inspiration photos and descriptions, but handmade work will vary slightly. Colors may differ from what you see on screen.
Accuracy: Please double-check your pickup/delivery date, time, address, and order details before checking out.

2.4 Pricing and Payment

Prices are listed in U.S. dollars and may change without notice. Prices at the time of your order apply to that order.
Applicable taxes, delivery fees, and other charges will be shown at checkout.
Payments are processed securely by Square. We do not store your full card number.
We may require a deposit or full payment to reserve your date.

2.5 Pickup and Delivery

Pickup: Please pick up during your scheduled window at the location we give you after your order is confirmed. If you don't pick up within 3 hours of your window and we can't reach you, we may treat the order as abandoned and no refund will be issued.
Delivery: Please provide an accurate address and a working phone number. Someone must be available to receive the order, and we're not responsible for delays caused by incorrect information or conditions beyond our control.
After handoff: Once your order is picked up or delivered, you are responsible for proper storage, temperature, and handling. Heat, humidity, travel, and time can affect baked goods, especially frosted or filled cakes. Please keep cakes cool and level during transport.

2.6 Allergies and Food Safety

We take care in our kitchen, but we cannot guarantee that any product is free from allergens or traces of allergens. You are responsible for deciding whether our products are safe for you and your guests. Please review the information provided before ordering and contact us with questions.

2.7 Your Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

Submit false information or use someone else's payment method without permission.
Interfere with the Site's operation or attempt to access it without authorization.
Copy, scrape, or reuse our content for commercial purposes without written permission.

2.8 Intellectual Property

The content on this Site, including our name, logo, photographs, cake designs, text, and graphics, belongs to us or is used with permission, and is protected by copyright and trademark laws. You may share links and photos of your own order on social media with credit to us, but you may not otherwise reproduce or use our content without our written permission.

2.9 Photos and Reviews

If you tag us, send us photos, or leave a review, you give us permission to share that content on our website and social media, with credit where possible. Tell us anytime if you'd rather we not.

2.10 Disclaimer of Warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we make no promises that the Site will always be uninterrupted, error-free, or free of harmful components. Nothing in these Terms excludes any warranty or right that cannot be excluded under Texas or federal law.

2.11 Limitation of Liability

To the fullest extent permitted by law, B's House of Cakes Houston and its owner, employees, and contractors will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. This section does not limit liability that cannot be limited under applicable law.

2.12 Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. If a dispute arises, please contact us first at bshouseofcakes@gmail.com so we can try to resolve it informally. Any dispute that can't be resolved informally will be handled in the state or federal courts located in Harris County, Texas, and you consent to that venue.

2.13 Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows when changes were made. Orders are governed by the Terms in effect when the order was placed.
